These terms and conditions govern The Bubbles Reviewers Club program. When you sign up for your membership you acknowledge that you accept these terms and conditions in full.
Age Requirements
You must be 18 years or older to join the club. We reserve the right to request identification for age verification purposes at any time.
The Bubbles Reviewers Club Program
This program is a club designed to provide suggestions, tasting notes, and online guided tastings on sparkling wines each month. Our team research and select a special sparkling wine to feature each month. The aim is to introduce you to new bubbly discoveries showcasing diversity in sparkling wine, including different methods, blends, and terroir. You accept that each month will be a different sparkling wine chosen by The Bubbles Review team.
Alcohol Deliveries and Liquor Licence
The Bubbles Review is not selling or providing any alcohol. Your payment is for club membership and not directly for alcohol purchases. Any alcohol deliveries are issued by the club wine partners (wineries and distributors) as part of our club promotional arrangements and provided by them directly under their liquor licence and are not provided by The Bubbles Review.
Delivery Addresses
Our membership includes delivery to Australian addresses only.
By providing your delivery address you agree for The Bubbles Review to pass on these details to our club wine partners.
In providing your delivery address you agree that these are your correct delivery details. Any errors in delivery addresses are the responsibility of the club member and any costs incurred in re-delivering club member monthly deliveries are at the cost of the club member.
In the event of an error in delivery information or failure to collect a delivery within a requested timeframe, we reserve the right to pass on any additional delivery costs to the club member by billing the credit card provided.
Personal Information
When we collect details to join our club, we only obtain the information needed to identify you to confirm your age for legal purposes and contact you for passing on information by email for club activities online and provide your details for delivery of sparkling wines. Membership Options
You can sign up for a Monthly Membership or an Annual Membership Plan.
Billing
By signing up for this Club Membership you agree for ongoing billing charged to the credit card provided when you signed up.
Monthly Membership Plan – you will be charged when you first sign up for either the current or following month (depending on the date you join) and then each month after that on the 1st of the month.
Annual Membership Plan – you will be charged when you sign up and each year on the anniversary of your sign-up date.
Membership Start Date
When you sign up, you’ll receive an email confirmation along with access details for any additional bonuses.
If you’ve signed up after the 3rd of the month, your first delivery month will start from the following month.
Monthly Deliveries
Orders are placed with the winery or importer/distributor on the 3rd of each month and are usually dispatched by them within 3 business days. Depending on where you live and delivery time to your area you can expect your delivery to arrive between the 7th and the 15th of each month.
Failed Subscription Charges
It is the club member’s responsibility to provide a valid credit card for the monthly membership charge. If we are unable to charge your card on the charge date for your membership we reserve the right to withhold club privileges including online activities, promotional offers and wine deliveries until the membership payment is made. If the payment is not made before our club wine partners dispatch wine deliveries we reserve the right to cancel your wine delivery for that month.
Refunds
There are no refunds once you’ve been billed for the current month.
Cancellations
You can cancel any time as long as you give 3 business days notice before the next billing date. To cancel you must notify us in writing and ensure you receive a confirmation of your cancellation by us by email in reply.
Other Parties and No Warranties
Our club partners are independent of THE BUBBLES REVIEW. As an independent party, THE BUBBLES REVIEW makes no warranty to the quality of any of the goods or inclusions provided by other parties that are included in the club membership.
You accept that, as a limited liability entity, THE BUBBLES REVIEW has an interest in limiting the personal liability of its officers and employees. You agree that you will not bring any claim personally against THE BUBBLES REVIEW’S officers or employees or contractors in respect of any losses you suffer in connection with the club membership. Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this disclaimer will protect THE BUBBLES REVIEW’S officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as THE BUBBLES REVIEW.
Unenforceable Provisions
If any provision of this disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this disclaimer.
Indemnity
You hereby indemnify THE BUBBLES REVIEW and undertake to keep THE BUBBLES REVIEW indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by THE BUBBLES REVIEW to a third party in settlement of a claim or dispute on the advice of THE BUBBLES REVIEW’S legal advisers) incurred or suffered by THE BUBBLES REVIEW arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.
Breaches of these Terms and Conditions
Without prejudice to THE BUBBLES REVIEW’S other rights under these terms and conditions, if you breach these terms and conditions in any way, THE BUBBLES REVIEW may take such action as THE BUBBLES REVIEW deems appropriate to deal with the breach, including suspending your access to the club, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website.
Variation
THE BUBBLES REVIEW may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the club membership from the date of the publication of the revised terms and conditions. Please check this page regularly to ensure you are familiar with the current version.
Assignment
THE BUBBLES REVIEW may transfer, sub-contract or otherwise deal with THE BUBBLES REVIEW’S rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.
You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.
Severability
If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
Entire Agreement
These terms and conditions together with Purchasing and Privacy Policies constitute the entire agreement between you and THE BUBBLES REVIEW in relation to your club membership and supersede all previous agreements.
Law and Jurisdiction
These terms and conditions will be governed by and construed in accordance with GOVERNING LAW in the State of Victoria, Australia, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of the State of Victoria, Australia.
